could be wrong, but there's probably nothing (technically) unconstitutional about, you know, "creating" vacancies on the Supreme Court.

So why not?

Nice Supreme Court you got here. Would be a shame if something happened to it.

Of course, you'd only want to do that when your party controls both the WH and the Senate. Heck, just controlling the Senate is enough for the controlling party to keep a vacancy open indefinitely, you know, until favorable circumstances developed. It's a gamble, but it's been known to pay off handsomely.
